This privacy policy explains how LOBBY5 as LOBBY 5 PORTAL L.L.C (collectively, “LOBBY 5 PORTAL L.L.C”, “we,” “us,”, and “our”) collects, uses, shares, and processes information about you (collectively, “you”, “user”, “customer”, Consumer’’,”beneficiary(s)”,”Merchant”, ‘’Business’’, ‘’Service Provider’’, “Third Party Service Provider”). This privacy policy describes our practices concerning your personal data that we process and information we record when we provide you with our services, including the services available through our website, portal and application and other services where we link this Policy (collectively the “Services”, “LOBBY5”).

Please read this Privacy Policy and all other applicable terms carefully before you start to use LOBBY5. By using LOBBY5 or signing up for an account, you accept and agree to be bound and abide by the Agreement and consent to and agree that we may collect, process, use, retain, disclose, and transfer your Personal Data as described in this Privacy Policy. If you do not agree to the full Agreement, you must not access or use LOBBY5.

We reserve the right to change this Privacy Policy at any time and without prior notice. We may alert you that changes have been made by indicating the “last updated” date of the current version. We encourage you to review this Privacy Policy to make sure that you understand how any Personal Data we collect will be used.

If you are a business, store’s owner, or service provider (“Merchant”), you will be as well bonded to our Service Agreement.

1. APPLICABILITY AND ELIGIBILITY
We need to process your Personal Data to operate our organization and provide you with our Services. By accepting the Agreement, you are confirming that you have read and understood these policies, including how and why we use your Personal Data. If you don’t want us to collect or process your Personal Data in the ways described in this Privacy Policy, you should not use the Services. Please note we are not responsible for the content or the privacy policies or practices of any third-party organization or service that interact with our Services. We encourage you to read the privacy policies of these third-party organizations before using any of the Services.

2. PERSONAL DATA WE COLLECT
As used herein, the term “Personal Data” means any information relating to an identified or identifiable natural person including information that specifically identifies an individual (such as a name, address, license, contact numbers, Government ID, e-mail address, Company Information, credit card number, Descriptions of the services and goods, Pictures, identification number, mobile device information, location data, an online identifier, information of persons, things, equipment or goods that user requested service for). Personal Data does not include aggregate data, which is data we collect about the use of the Services or about a group or category of services or users, from which an individual’s identity cannot be discerned and all other Personal Data has been removed. This Privacy Policy in no way restricts or limits our use of aggregate data.


We rely on a number of legal bases to process the information we receive about you from your use of the Services, including where:

Account Information: you may register for an account with us (“Merchant Account”, “User Account”). We will collect certain information about you in connection with your registration for a Merchant Account or User Account, which may include Personal Data, username and password and other information as requested in registration fields.

Personal Data: We will collect information about you in connection with your services and Account as provided by you during service listings, service requests, or noted and recorded by us, our partners and service providers prior, during, or after providing the services for things related to the service requested by you.

Please note that we work with third parties (“Third Party” , “Third Parties”) to facilitate services provided.

Payment Transaction Information: We may collect information related to purchases made through the Services. You may provide certain information to complete payments via the Services, including your credit or debit card number, name of card’s owner, card expiration date, CVV code, and billing address (collectively, “Payment Information”, “Payment details”), along with your name and billing, address, to complete payment transactions through certain services. Please note we work with “Payment Processor” to handle payment transactions. We do not collect or maintain your credit card or other financial account information; this information is handled for us by our Payment Processors. You are subject to the privacy policies and terms and conditions of each Payment Processor when utilizing our services or services of Merchants through our Services.

Your Content. Any information, text, documents, comment you leave for any Merchant or third party inside any document, graphics, videos, audio files, or other materials uploaded, posted, displayed, shared and otherwise made available by you on public or through the Service will be collected and stored by us. Your Content is not shared with anyone except those you voluntarily decide to share it with or Merchants you have requested a Service from through the Services. You are solely responsible for your Content. You assume all risks associated with the use and sharing of your Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your Content that makes you or any Merchant or third party personally identifiable.

Please note that providing personal information to us is voluntary on your part. If you choose not to provide us certain information, we may not be able to offer you certain or all products and services, and you may not be able to access certain or all features.

LOBBY5 is not responsible for any content you share with Users, Merchants or third parties.

Correspondence Information: If you sign up, email us, subscribe to our Services, blogs, newsletters, or mailing lists, we may keep your messages, email address, and contact information to respond to your requests, provide the requested products or Services, and to provide notifications or other correspondences to you. We do not share or sell any Personal Data to other organizations for commercial purposes.

If you supply us with your communication or postal addresses, you may receive periodic mailings from us with information on new products and services or upcoming events. If you do not want to receive communications from us in the future, please follow the instructions found in any e-mail we send or help topics we post on our websites.

Please note requests to remove your correspondences information from our lists may take some time to fulfill. We may also still contact you as needed to provide important announcements or notifications regarding your Personal Data, or Services.

Support Information: You may provide information to us or Merchants through a support request submitted via the Services. This information will be used to address your support request. Please avoid submitting confidential or sensitive information in a support request if you do not want it to be accessed or used in the future.

Public information: We may also collect information about you from publicly available sources. Information you make publicly available in any public or open forum, such as on a social network, may be considered public information for the purposes of this Privacy Policy, and may be accessed and collected by us. Furthermore, any content or information you share through or in relation to the Services with Users, Merchants or third parties are neither private nor confidential. We are not responsible for any content or information you post or share with Merchants or third parties. If you do not wish for certain information to be public, please do not share it publicly.

3. INFORMATION COLLECTED AUTOMATICALLY
We use automatic data collection and analytics technologies to collect aggregate and user-specific information about your devices, equipment, domain name, patterns of use, communication data and the resources that you access and use on the Services or include your IP address. This information is used to improve our Services.

We generally process information collected automatically on the legal basis of our legitimate interests in assessing the use of our Services. Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing.

Information we collect automatically through your use of the Services includes:
We, along with our third parties, may use and combine such collected anonymous information for business purposes, including but not limited to improving services, tailoring the App, compiling and analyzing statistics and trends, monitoring App activity and performance, and otherwise administering and enhancing the App. However, such information is not combined with your Personal Data collected.

Additionally, we may collect and utilize information to support the development of new business initiatives or services within the same group of affiliated companies, always in accordance with applicable privacy laws and regulations.

Geo-location information: If you are accessing our Services, you may be asked to share your precise (GPS level) geo-location information. Such geolocation information may include physical locations visited (latitude & longitude). If you agree to such collection, in most cases, you will be able to turn off such data collection at any time by accessing the privacy settings of your devices. You will be also requested to provide your geo-location which is essential to identify your location or deliver any service to you.

Information collected by and from social media services and other third-party platforms: Our users can engage in content on or through social media services or other third-party platforms, integrations, and applications. When you engage in our content on or through social media services or other third-party platforms, plug-ins, integrations, or applications, you may allow us to have access to certain information in your profile or posts you made public.

For a description on how social media services and other third-party platforms, plug-ins, integrations, or applications handle your information, please refer to their respective privacy policies and terms and conditions, which may permit you to modify your privacy settings.

When you interact with our content on third-party sites or platforms, we may collect information about your activity, such as content viewed, ads shown or clicked, and questions asked.

Analytics information: We use data analytics to ensure the app functionality and improve the Services. We may use mobile analytics tools to allow us to understand the functionality of the Services on your devices. This tool may record information such as how often you use the Services, what happens within the Services, aggregated usage, performance data, app errors and debugging information, and where the Services were downloaded from.

Log file information: When you use our Services, we may receive log file information such as your
• IP address;
• access times;
• domain names operating system;
• the referring web page(s);
• pages visited;
• location;
• your mobile carrier;
• device information (including device and application IDs); search terms; and cookie information.

We receive log file data when you interact with our Services, for example, when you go to our app, sign into our Services, or interact with our email notifications. We use log file data and to provide, understand, and improve our Services, create new apps, or to customize the content we show you. We may link this log file to other information we collect about you via the Services.

4. DEVICE IDENTIFIERS
Mobile Apps use unique identifiers associated with your device, such as the device Advertising ID; the advertising ID will be removed when a user opts out of personalization using advertising ID in its mobile Settings. Mobile Advertising Identifiers are unique IDs that are similar to cookies, but instead of being stored on your web browser, are associated with individual mobile devices. They usually are user resettable. Like other Digital Identifiers, Mobile advertising identifiers do not tell us who an Internet user is in the “real world”, but may, when combined with other information, allow the identification of an individual. Mobile advertising identifiers are used in connection with apps on your mobile device as opposed to websites that you access through a browser.

Apple iOS Advertising ID (IDFA). You can change your Apple Advertising ID settings by following these instructions: open Settings on your device and go to Privacy > Tracking.

HOW LOBBY5 SHARES YOUR PERSONAL DATA

We use the information we receive about you for the purposes described in this Privacy Policy. We generally process Personal Data received about you through our Services on the legal basis of our legitimate interests in providing the Services and their functionality to you where such processing is necessary for the purposes of the legitimate interests pursued by us or by our service providers related to the Services. Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing or pursuant to performance of a contract. We will not share, sell, rent, or otherwise disclose your Personal Data to third parties without your consent or another valid legal basis permitted by law.

We will share your information in the following circumstances on the legal basis of the legitimate interests of providing the requested Services:

Merchants: We will share your personal data you share with us with registered Merchants in order to provide you with services you have requested through the App.

Third Parties: We use third parties to support our business such as payment processors, encrypting credit card data as a further measure of securing the data, processing credit card payments, technical and administrative support, and providing comparative performance information relative to our application (“Third Parties”). These third parties have limited access to your information and may use your information only to perform these tasks for our services or on our behalf. Information we share to our Third Parties may include both information you provide to us and information we collect about you, including Personal Data and information from data collection tools like cookies, web beacons, and log files.

We may disclose the personal data that you have provided to us to Third Parties that we have engaged to perform business-related functions on our behalf, but only:

• To Third Parties we use to support our business (such as services, technical support, and financial institutions) or assist in providing the Services, in which case we will require such third parties to agree to treat your personal data in accordance with this policy and use it for the same purposes;

• in connection about the sale, assignment, merger, or other transfer of the business to which the information relates, in which case we will require any such buyer to agree to treat your personal data in accordance with this privacy policy and use it for the same purposes; or

Business transactions: We may purchase other businesses or their assets, sell our business assets, or be involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets (a “Business Transaction”). Your information, including Personal Data, may be among assets sold or transferred as part of a Business Transaction. In some cases, we may choose to buy or sell assets. Such transactions may be necessary and in our legitimate interests, particularly our interest in making decisions that enables our organization to develop over the long term.

We also use return e-mail addresses to answer the email we receive from you. Your e-mail address will not be used for any other purpose or shared with outside third parties for their direct marketing purposes. We may also use your IP address to help protect LOBBY5 and our Service Providers from fraud.

Other purposes: LOBBY5 may also disclose your personal data as is necessary to:

• cooperate with law enforcement or other government agencies;
• establish or exercise our legal rights;
• protect the safety of our company and employees, merchants, third parties, contractors, vendors, suppliers, and customers;
• defend against legal claims;
• help with internal and external investigations; or
• as otherwise required by law or permitted by law.

We may disclose your information and Personal Data in connection with a sale or merger of LOBBY5 or any transaction that involves the sale or assignment of some or all our assets.
Aggregated Non-Personal Data: We may disclose aggregated, non-personal data received from providing the Services, including information that does not identify any individual, without restriction. We may share demographic information with third parties and business partners, but it will be aggregated and de-personalized, so that personal data is not revealed.

We intend to protect your personal information and to maintain its accuracy. We implements reasonable physical, administrative, and technical safeguards to help us protect your personal information from unauthorized access, use and disclosure.

6. INSTALLING OR USING LOBBY5
To provide you with certain services and support ad attribution, limited user data may be shared with certain Third Parties and service providers when you install, download or use LOBBY5. This may include your IP address or other unique identifier, and event data related to the installation or use of LOBBY5.

This may be done for a variety of purposes, including facilitating user log-in through third-party accounts. It may also assist us to understand and optimize our users’ complete customer journey by helping us: (i) understand how users arrive to the services; (ii) better measure the performance of our ads; and (iii) understand where a user has accessed the app or services through different devices.

By downloading, installing, or using LOBBY5, you consent to the transfer of your Personal Data to third parties and service providers, agree to LOBBY5’s Privacy Policy and terms, including term and conditions, service agreements, and are informed of your rights, including objecting to the use of your data for marketing.

7. STORAGE
Please also be aware that we may also use third-party cloud service providers, including direct and indirect partners for service support, that provide hosting, data storage and other services pursuant to standard terms and conditions that may be non-negotiable. These parties apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the change of their policy, misuse of any information or Personal Data.

8. APP STORE PLATFORMS
Currently, our platform is available using third party app store platforms such as Google Play and Apple Store. 9. LINKS TO THIRD-PARTY PROVIDERS
LOBNBY5 may make available links to other third party websites, or services. When you click on such links, you may leave our App and go to the third party website URL or app you clicked from, and this URL may include search terms and filters you used on the app.

We are not responsible for the information collection, use, disclosure, or other privacy practices of any third party, including our affiliates, third party service providers, employers, any third-party social media platform, any third party making available the devices or operating systems for which the app is available, and any third party operating any website to which the app contain a link. You may have rights directly enforceable against these third parties so you should consider their privacy policies to learn more.

10. YOUR RIGHTS AND CHOICES
We seek to ensure all individuals are provided with the rights mandated by their governing jurisdiction. Not all the rights discussed in this Privacy Policy will apply to each individual data subject and may not apply to you depending upon your jurisdiction.

You may benefit from several rights in relation to your information that we process. Some rights apply only in certain limited cases, depending on your location. If you would like to manage, change, limit, or delete your personal data, you can do so by contacting us via EMAIL available in our official accounts and ensure our receipt of such email.

Data retention. We will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as an account is active or as needed to provide the Services to you. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. Users or Merchants may opt-out of receiving certain communications from us by following the unsubscribe process described in email communication, or by contacting us using the contact information provided. However, please note you may not opt-out of certain Services-related communications, such as account verification, changes or updates to features of the Services, or technical and security notices.

Do Not Track. We do not currently employ a process for automatically responding to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including personal data, about your online activities over time and across different websites, app or online services when you use Services.

11. THE RIGHT TO RECTIFY YOUR PERSONAL DATA
Users of the software are able to edit and update most of their Personal Data held by each company on the App, and if you have any queries or complaints, we encourage you to contact us. Alternatively, you may make a formal request to have LOBBY5 rectify any inaccurate Personal Data on your behalf by sending an email to us from the email address associated with your account.

The Right to Object to or Restrict the Processing of Your Personal Data. If you have any queries or complaints about how we process your Personal Data, we encourage you to contact us through our official email address from the email address associated with your account.

The Rights of Access to and Portability of Your Personal Data. Users can access most of their Personal Data provided on the app, and if you have any queries or complaints, we encourage you to contact us. Alternatively, you may make a formal request to access your Personal Data held by LOBBY5. To do so, you may be requested to fill in certain forms. You acknowledge that process may require reasonable time in which defined by us. All communications should be done from the email address associated to your account through our official email addresses.

The Right to Delete Your Personal Data. Users of the app can edit and update most of their Personal Data provided on the app, and if you have any queries or complaints, we encourage you to contact us. Alternatively, you can make a formal request to delete your Personal Data from our app. To do so, you may be requested to fill in certain forms. You acknowledge that process may require reasonable time in which defined by us. All communications should be done from the email address associated to your account through our official email addresses.

Once your request has been confirmed, we will initiate the necessary steps to fulfill your request, including the deletion of any applicable account. If you have interacted using more than one email address, please submit a subsequent request with the additional email addresses so that we may delete this personal data as well.

12. WITHDRAWING CONSENT
There are certain activities where we ask for your consent to use your Personal Data. You have the right to withdraw this consent at any time. Where you are providing location information via a mobile app, you may turn off your location services on your device at any time. For other services that rely on your consent, you can withdraw your consent via the workflow for that given service. Please note that any processing that we have carried out before the withdrawal of your consent remains lawful.

13. OPTING OUT OF MARKETING MESSAGES AND WITHDRAWING CONSENT
If you no longer wish to receive marketing communications from us based on your Personal Data, you have several options:

• To opt out of a specific marketing email, simply click the “unsubscribe” link (or similar option) included in the message. Please note that this action will only remove you from that particular mailing list. Processing your request may take a reasonable amount of time, as determined by us.
• To opt out of all marketing communications, you may send a request from the email address associated with your account to one of our official email addresses. We will process your request as soon as reasonably possible.

16. CHILDREN AND DATA COLLECTION
The Services are not directed toward children who are under the age of 21. You may not use the Services if you are under the age of 21. If you are under the age of 21, you should not provide any information on our Services. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from anyone underage without verification of parental consent, we take steps to remove that information from Our servers.

We do not knowingly collect Personal Data from children or minors. If we or our Third Party Service Providers become aware that a child or minor has provided us with Personal Data without parental consent, that information may be deleted from our databases.
